The Public notary and the Public Corridor are officials to whom the Mexican Government grants them “public faith” for what they receive the name of public notaries.
All acts that are granted before these notaries are not questionable, with the certification that they carry out the corresponding act to describe a public deed.
Public notary
The Public Notary is an official of the State that provides the guarantee of legitimacy and security for individuals and the State.
Each State has its own notarial law, which regulates both its activity and the requirements to be a notary, responsibilities, rights, obligations and penalties. Main features:
➲ The Notary can give public faith regarding acts of civil, commercial or other matters. It has a general and broad field of action regarding legal issues in general.
➲ He/She receives a patent from the state or local government to exercise his/her function in the territory of the federative entity that corresponds to them, that is, he/she can only act in a given state.
➲ The notary is not an appraiser, arbitrator or intermediary agent.
Public Broker
The Public Broker is a Law graduate trained by the Federal Executive, through the Ministry of Economy that can exercise the functions established by the Federal Law of Public Brokerage and its Regulations.
This official is impartial in all the businesses in which he intervenes and is obliged to keep professional secrecy, besides guaranteeing legal security and certainty.
Among the obligations that must be fulfilled, the Public Broker must guide and explain to the grantors the value and the legal consequences of the acts that are treated. Main features:
➲ The broker can give public faith exclusively in acts of commercial law, since they are considered a legal adviser specialized in commercial matters, and therefore can not give public faith regarding civil acts.
➲ He/She can practice throughout the Mexican Republic and not only in a particular State.
➲ The law recognizes the status of expert appraiser, arbitrator, mediator agent, legal adviser and public notary. Both officers are different with different fields of action and differentiated faculties. If it is a civil procedure it is better to go to a notary, and if it is a mercantile procedure it is convenient to go with a broker.
