{"id":9623,"date":"2018-08-08T11:10:44","date_gmt":"2018-08-08T16:10:44","guid":{"rendered":"https:\/\/quadranslawandfinance.com\/?p=9623"},"modified":"2020-05-28T12:57:50","modified_gmt":"2020-05-28T17:57:50","slug":"differences-notary-and-broker","status":"publish","type":"post","link":"https:\/\/quadranslawandfinance.com\/en\/blog\/differences-notary-and-broker\/","title":{"rendered":"Differences between a notary and a broker."},"content":{"rendered":"<h3 style=\"text-align: center;\"><span style=\"color: #02afa0;\"><strong style=\"font-size: 16px;\">The Public notary and the Public Corridor are officials to whom the Mexican Government grants them &#8220;public faith&#8221; for what they receive the name of public notaries.<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">All acts that are granted before these notaries are not questionable, with the certification that they carry out the corresponding act to describe a public deed.<\/span><\/p>\n<h2><span style=\"color: #02afa0;\"><strong>Public notary<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\">The Public Notary is an official of the State that provides the guarantee of legitimacy and security for individuals and the State.<\/span><\/p>\n<p><span style=\"color: #000000;\">Each State has its own notarial law, which regulates both its activity and the requirements to be a notary, responsibilities, rights, obligations and penalties. <em>Main features<\/em>:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 The Notary can give public faith regarding acts of civil, commercial or other matters. It has a general and broad field of action regarding legal issues in general.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 He\/She receives a patent from the state or local government to exercise his\/her function in the territory of the federative entity that corresponds to them, that is, he\/she can only act in a given state.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 The notary is not an appraiser, arbitrator or intermediary agent.<\/span><\/p>\n<h2><span style=\"color: #02afa0;\"><strong>Public Broker<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\">The Public Broker is a Law graduate trained by the Federal Executive, through the Ministry of Economy that can exercise the functions established by the Federal Law of Public Brokerage and its Regulations.<\/span><\/p>\n<p><span style=\"color: #000000;\">This official is impartial in all the businesses in which he intervenes and is obliged to keep professional secrecy, besides guaranteeing legal security and certainty.<\/span><\/p>\n<p><span style=\"color: #000000;\">Among the obligations that must be fulfilled, the Public Broker must guide and explain to the grantors the value and the legal consequences of the acts that are treated. <em>Main features<\/em>:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 The broker can give public faith exclusively in acts of commercial law, since they are considered a legal adviser specialized in commercial matters, and therefore can not give public faith regarding civil acts.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 He\/She can practice throughout the Mexican Republic and not only in a particular State.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u27b2 The law recognizes the status of expert appraiser, arbitrator, mediator agent, legal adviser and public notary. Both officers are different with different fields of action and differentiated faculties.
