{"id":8847,"date":"2018-05-31T16:19:06","date_gmt":"2018-05-31T21:19:06","guid":{"rendered":"http:\/\/quadranslawandfinance.com\/?p=8847"},"modified":"2018-06-28T11:28:49","modified_gmt":"2018-06-28T16:28:49","slug":"reforms-industrial-property-law","status":"publish","type":"post","link":"https:\/\/quadranslawandfinance.com\/en\/blog\/reforms-industrial-property-law\/","title":{"rendered":"Reforms to the Industrial Property Law"},"content":{"rendered":"<h1 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Reforms to the Industrial Property Law<\/strong><\/span><\/h1>\n<p><span style=\"color: #000000;\">The Law of Industrial Property aims to promote creativity for the designs and presentation of new and useful products; in addition to regulating and granting patents of invention, records of utility models, industrial designs, trademarks and commercial notices, publication of trade names, protection of denominations of origin and regulation of industrial secrets.<\/span><\/p>\n<p><span style=\"color: #000000;\">The modifications that are made in the Industrial Property law are to improve the protection of creativity in the industrial designs, and obey the simplification and homogenization of regulations and procedures with the international scope.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #000000;\"><a style=\"background: url('http:\/\/twitter.antoniorull.com\/img\/tuit.png') right top no-repeat rgba(0, 152, 209, 0.1); padding-right: 15px; color: #000000;\" href=\"https:\/\/twitter.com\/intent\/tweet?url=http%3A%2F%2Fquadranslawandfinance.com&amp;text=The%20updating%20of%20the%20reforms%20to%20the%20Industrial%20Property%20Law%20will%20bring%20benefits%20to%20the%20country.-%C2%A0Senate%20of%20the%20Republic \" target=\"_blank\" rel=\"noopener\">The updating of the reforms to the Industrial Property Law will bring benefits to the country.-\u00a0Senate of the Republic<\/a><\/span><\/h3>\n<p><span style=\"color: #000000;\">The National Official Gazette has published several reforms to the Industrial Property Law last <u>ay 22<\/u> of the current year, which include the following:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\">The registration of olfactory brands (that is, to protect a particular odor) and auditory or sound brands will be allowed. The objective of this is to promote competition and to attract new products to our country.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">With this reform, the meaning of a brand is updated so that it is considered to mark every visible sign for the senses and that can be presented.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\">The obligation is imposed by the registered trademark owners to present a declaration of use of the trademark every three years before the Mexican Institute of Industrial Property. If this declaration is not presented, the trademark will expire.<\/span><\/li>\n<li><span style=\"color: #000000;\">The registration of certification brands will be allowed, which are signs that distinguish products and services whose qualities or other characteristics have been certified by its holder, such as:<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">I. The components of the products;<\/span><\/p>\n<p><span style=\"color: #000000;\">II. The conditions under which the products have been manufactured or the services rendered.<\/span><\/p>\n<p><span style=\"color: #000000;\">III. The quality, processes or other characteristics of the products or services, and<\/span><\/p>\n<p><span style=\"color: #000000;\">IV. The geographical origin of the products.<\/span><\/p>\n<p><span style=\"color: #000000;\">This is done in order to add greater value to the brand and to be able to generate more quality products and services, always through legal competence.<\/span><\/p>\n<p><span style=\"color: #000000;\">*These reforms will come into force within 60 days.<\/span><\/p>\n<p><span style=\"color: #000000;\">At Quadrans we like to keep our clients informed with legal updates that arise.
