Your trademark is the identity of your firm. Failing to register it could put your products or services at risk

Having a business requires investment in monetary resources, time, goals, and ideas, which
makes your work and effort extremely valuable. But having a trademark also demands that
you register it to protect it and differentiate yourself from your competitors. This allows you to
be noticed by any potential client and position your firm independently in the market.

What would happen if you did not register your trademark? Essentially, someone else could
register it and use it as their own. Even if such products or ideas are not theirs, there would
not be any legal basis to prove otherwise. And if that person does decide to use them, you
could get involved in a series of legal conflicts if you continue the normal operations of your
business. That would force you to begin different processes to recover your rights, and
unfortunately, they could take years.

Trademarks are protected and registered before the Mexican Institute of Industrial Property
(IMPI). In Mexico, this registration lasts 10 years, and once it concludes, it must be renewed.

Registering your trademark also gives you the possibility to grow your business. For
instance, with it you would be able to licence and franchise your products or services.
And the more the business grows, the more valuable the trademark becomes.

There are different types of trademarks in the country:

Wordmark: Composed of one of more words.
Pictorial mark: Graphic designs that omit the use of words, and thus cannot be
expressed phonetically, but rather visually.
Three-dimensional: Containers or packages represented volumetrically
(three-dimensionally).
Mixed: Combination between any of the aforesaid types.

You can follow certain steps to register your trademark:

● Verify that the trademark fulfills all requirements.
● Research the category under which you want to register the trademark.
● Carry out a phonetic search.
● Send the trademark application and make the corresponding payment.
● Submit your application before the IMPI.
● Periodically check the status of your trademark application.

Asking a professional to provide you with advice and help you register your trademark will
enable you to maintain order in your business and avoid all worries. Think about the future of
your trademark and carry out every process you need to protect it today.
